This statement addresses the application of 18 U.S.C. § 2257 and its implementing regulations (28 C.F.R. Part 75) to content that appears on sextflirt.com.
All persons appearing in any visual depiction of actual sexually explicit conduct published on sextflirt.com were over the age of 18 at the time the content was created. sextflirt.com does not knowingly host or permit the posting of any content that depicts minors in any context, and any such content is removed immediately and reported to the appropriate authorities.
1. SCOPE OF THIS STATEMENT
sextflirt.com is an online directory and discovery platform for adult-oriented content. The overwhelming majority of what appears on the Site is uploaded directly by users, and the rest consists of previews, thumbnails, and profile links referring to content that lives on third-party platforms.
This 2257 statement covers both types of content and explains where legal record-keeping responsibility lies in each case.
2. USER-GENERATED CONTENT
Content posted by users, images, videos, carousel posts, stories, and associated captions, is uploaded to sextflirt.com by the individual account holders. Under 28 C.F.R. § 75.1(c)(4) and related guidance, sextflirt.com is not the primary or secondary producer of user-generated content. The user who creates or originally produces the content is the producer for § 2257 purposes and is responsible for:
- verifying, in advance of publication, that every performer depicted was at least 18 years old at the time of production;
- maintaining the records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75, including government-issued photo identification of each performer;
- keeping those records accessible to the Attorney General for inspection in accordance with the statute;
- displaying the required notice, where applicable, in connection with the content they publish.
By uploading content to sextflirt.com, the user represents and warrants that:
- every person depicted in the content is at least 18 years of age;
- the user holds or can produce the records required to substantiate that fact;
- the user is the rightful producer of, or has lawful authorisation to publish, the content in question.
3. LINKED AND REFERENCED THIRD-PARTY CONTENT
Parts of sextflirt.com refer visitors to external platforms, including but not limited to Snapchat, Kik, TikTok, Telegram, OnlyFans, Instagram, Discord, WhatsApp, Twitch, and YouTube. When a user shares a handle on one of these platforms, or when an editorial listing links to a profile on another service, sextflirt.com is merely identifying the third-party destination. We do not host, store, or control the content that lives on those external platforms, and we are not the producer of that content for § 2257 purposes.
Record-keeping for content on third-party platforms is the responsibility of the original producer and the platform that hosts it, in accordance with that platform's own compliance procedures.
4. OUR ROLE AND LEGAL POSITION
sextflirt.com operates as an online service that transmits, routes, stores, and displays user-submitted material. In the statutory taxonomy of 28 C.F.R. Part 75, sextflirt.com does not "produce" content within the meaning of § 2257; its activities with respect to user uploads are limited to the kind of transmission, hosting, and display functions that the regulation expressly excludes from the definition of production.
Notwithstanding this, as a matter of policy sextflirt.com:
- requires every uploading user to confirm the age-of-majority status of every person depicted before the content is published;
- applies automated and manual moderation to user uploads to detect and remove material that may involve minors;
- cooperates with law enforcement in investigations relating to suspected exploitation of minors;
- reports any such material to the National Center for Missing and Exploited Children (NCMEC) in accordance with applicable law.
5. REPORTING CONTENT THAT MAY VIOLATE THESE REQUIREMENTS
